Terms & Conditions (User Agreement)

We may make changes to the material on the Anti Fly Tipping Association (AFTA) website at any time without notice. In the instance that any previously supplied material or information is outdated, we do not commit to updating such information without prompting. Please review the website regularly for the latest news and developments.

1. Introduction

Use of this website and the services provided through www.afta.org.uk are conditional upon acceptance of the following terms and conditions. Unless otherwise specified, your acceptance of this User Agreement shall be indicated by your continued use of and/or registration with www.afta.org.uk. If you do not agree to these terms and conditions, you will cease the use of www.afta.org.uk with immediate effect.

These terms and conditions, alongside our Privacy Policy, comprise the User Agreement. This User Agreement governs all elements of chargeable and non-chargeable use of www.afta.org.uk. Please also be aware that this User Agreement supersedes any previous agreement or arrangement connected with AFTA, online or off.

If a company name is used in your registration request, the User Agreement shall be between AFTA and the named company. References to, “you” and, “yours” within the User Agreement will also apply to the named company. If this is not to be the case, and the User Agreement should be entered into as an individual, this must be made clear to AFTA.

The purchase of goods or services from AFTA Members is subject to the unique Terms and Conditions of the Member in question. AFTA are not responsible for the service or any works provided by one of our Members, and any contract entered into is subject to a separate agreement between the relevant parties.

2. Use of AFTA

www.afta.org.uk is intended for personal, non-commercial use. Any use of the content of www.afta.org.uk without written permission is verboten, outside of legal permissions under the Copyright, Designs and Patents Act of 1988.

Unless permitted under applicable law, you must not use, copy, translate, publish, licence or sell materials, including images, found on www.afta.org.uk without written consent. If you wish to request consent, please contact AFTA and explain what content you wish to use, and for what purpose. Every request will be assessed on an individual basis and a decision will be provided in writing.

3. Availability

We will endeavour to ensure that www.afta.org.uk is available 24 hours per day without interruption. However, we reserve the right to make www.afta.org.uk unavailable at any time, or to restrict access to parts or all of www.afta.org.uk without notice.

We make every attempt to ensure that information on www.afta.org.uk is never misleading. However, we cannot state that all information found on www.afta.org.uk is not misleading and accept no responsibility if this the case.

4. Sharing AFTA content on social media

You agree to only use www.AFTA.org.uk for lawful purposes, and that any information that you share or provide in connection with www.afta.org.uk will be, as far as you are aware, true and accurate.

You will not infringe any copyright or trademark, right of privacy, publicity or personality, or rights, whether registered or unregistered, of any other nature or any person. You agree to indemnify us against all claims, proceedings, damages, liabilities and costs, including legal costs arising out of any breach of this term.

www.afta.org.uk includes links to other internet sites. AFTA makes make no representation or endorsement regarding the safety or content of these sites, nor that the links remain active.

6. Data Protection

It is your responsibility to ensure that you provide an accurate and valid e-mail address and other contact details, informing AFTA of any changes.

7. Intellectual Property

www.afta.org.uk – including its style, structure, content, badges, logos, corporate branding, materials and information on www.afta.org.uk – are protected by copyright, trademark, trade name and other intellectual property rights.

These materials may not be used unless permission is provided in this User Agreement or in writing by AFTA.

www.AFTA.org.uk, Anti Fly-Tipping Association and all badges and logos are registered trademarks of The Anti Fly-Tipping Association.

8. Liability

www.afta.org.uk is free and available to all. Ergo, it is a condition that your use of www.afta.org.uk is at your own risk. We shall not be liable for any breach of this User Agreement, nor delay or failure to perform any obligation if the delay or failure is due to a cause beyond our reasonable control.

Save as provided below, we disclaim all and will not be liable in contract, tort (including, without limitation, negligence) or otherwise arising in connection with this User Agreement or the use of www.afta.org.uk for any of the following:

Consequential, indirect or special loss or damage
Loss of goodwill or reputation
Economic losses (including loss of revenues, profits, contracts, business or anticipated savings), in each case, even if we have been advised of the possibility of such loss or damage and howsoever incurred.

Notwithstanding any other provision of this User Agreement, we will be liable to you without limit for any death or personal injury caused by our negligence. The extent of this liability arises under Part 1 or section 41 of the Consumer Protection Act 1987. This includes any liability arising from statements made fraudulently by AFTA.

No content found on www.afta.org.uk constitutes legal, medical or any other form of professional advice or guidance. Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We, therefore, disclaim any liability and responsibility arising from any reliance placed on such materials by any visitors to www.afta.org.uk or by anybody who may be informed of its contents.

9. Small Print

No part of this User Agreement shall confer upon a third party any benefit or the right to enforce any term of the User Agreement.

This User Agreement is governed by English law and any dispute connected with this agreement is subject to the exclusive jurisdiction of the English courts.

No part of this User Agreement impacts your consumer statutory rights.

10. Complaints

If you believe that your intellectual property or other rights are being infringed by www.afta.org.uk, or if you are dissatisfied with www.afta.org.uk or any aspect of the AFTA service, please contact AFTA to discuss the grounds of your complaint.

10. AFTA members charter and user agreement

You agree not only to these terms and conditions (user agreement) but also to our members charter in whole, and understand that if you breach our members charter by not complying with the rules of the members charter as stated when agreeing to when joining AFTA then then your membership will be terminated.

If you believe that your intellectual property or other rights are being infringed by www.afta.org.uk, or if you are dissatisfied with www.afta.org.uk or any aspect of the AFTA service, please contact AFTA to discuss the grounds of your complaint.
